THE CONSTITUTION OF APPLE ISLAND
We, the citizens of Apple Island, agree to the fullest extent to live by this article and to shape the government based on these following principles.
Article I
Political Positions and Duties
1. All executive duties will be carried out solely by the Delegate and Founder; executive power shall not belong to any other nation.
2. The Advisor to the Delegate is hereby granted the authority to advise the Delegate; the Delegate shall hold authoritative power over his or her Advisor.
3. The Represenative of Regions is hereby granted the authority to manage relations between Apple Island and foreign regions, excluding any authority regarding embassies.The Representative is granted the authority to advise the Executives (henceforth defined as the Founder and Delegate of Apple Island) on matters regarding embassies.
4. The Treasurer is hereby granted the sole authority to manage the currency and economic affairs of Apple Island.
5. The Commander is hereby granted the authority to manage the military and regional defense of Apple Island. He or she may authorize anti-raiding activities, and is legally bound to protect Apple Island to the best of their ability in the event of a regional crisis or regional security threat.
6. The Judge is hereby granted the authority to make rulings on the legality of bills and laws proposed in the Regional Assembly, and to call a Regional Assembly referendum on the passage of a constitutional amendment or additional article.
7. The Vice Delegate is hereby granted the authority to take over the Founder or Delegate position in case of either ceasing to exist.
8. The Delegate is hereby granted the authority to appoint the Vice Delegate without any interference from any other nation/member of Apple Island.
Article II
Regarding Invaders
A 'raid' is henceforth defined as:
An purposeful attempt to override a region by two or more World Assembly members via moving to a region and taking the World Assembly Delegate position by force; therefore ruining or damaging the region by changing the World Factbook Entry, banning and/or ejecting native nations, removing and/or adding regional tags, suppressing Regional Message Board posts, and/or otherwise causing damage to the region intentionally.
Therefore, an 'invader' is defined as:
Any nation or region that takes part in raids.
A 'major invader region' is defined as:
Any region with a focus on participating in raids, with 50 or more raids on their record.
OR any region LESS than 2 months old with 25-50 raids on their record.
Therefore, a 'minor invader region' is defined as:
Any region with a focus on participating in raids, LESS than 50 raids on their record. OR an invader region MORE than 10 years old with ONLY 50-100 raids on their record.
1. Any nation recently affiliated with The Black Riders, The Black Hawks or other major invader region will be ejected/banned on sight by either of the Executives.
2. Any nations that have been affiliated with any major invader region but has not been affiliated with them for a period of at least three months will not be ejected/banned on sight, but will be held under suspicion.
3. Any nation from a minor invader region with any history of past raids will be ejected/banned on sight by either of the Executives.
4. Any nation from a minor invader region with no history of past raids will not be ejected/banned immediately, but will be held under suspicion.
5. If more than one nation from a minor invader region with no history of past raids move to the region within a reasonably short period of time, both will be ejected/banned on sight.
6. If the Delegate establishes relations with any invader region, the Founder has all authority to eject/ban the Delegate from the region.
7. Any nation that was just refounded after 60 days or more of non-existence that has had history with an invader region may be sent a recruitment message, and if they come to Apple Island before any other region, they shall be given the power to remain in Apple Island.
Article III
Regional Message Board
1. All nations have the right to use the Regional Message Board, henceforth referred to as the RMB.
2. Any misuse of the RMB, such as posting profanity or violent, threatening messages will not be tolerated.
3. The Executives have the right to suppress any RMB posts, including, but not limited to profanity or violent/threatening messages.
Article IV
Preforming Anti-Raids
An 'anti-raid' is hereby defined as:
An action in which multiple World Assembly members move to a region to reverse the effects of a raid upon a raided region.
Therefore, a 'defender' is defined as:
Any nation or region that takes part in anti-raiding activities.
1. Other regions have the right to message the Founder or Delegate to request an anti-raid.
2. Nations residing Apple Island have the right to choose not to take part in anti-raids, though partaking in anti-raids is encouraged and expected.
3. The military may not carry out an anti-raid on any invader regions that were raided.
4. The military must prioritize raided defender regions to be saved first.
Article V
Running for a Government Position/Voting Sessions
1. To run for a Government Position, a candidate must meet the following requirements:
1. The candidate must check NationStates and and maintain a reasonable amount of activity within NationStates.
2. The candidate must visit NationStates regularly for at least 2 weeks before voting commences.
3. The candidate must have had no previous affiliation with any major invader regions.
4. The candidate must have participated in conversations on the RMB and must continue to do so while in the position.
5. The candidate must have read and understood, in full, the Constitution of Apple Island.
2. All voting sessions will be four days long, though it may be postponed four more days by either of the Executives if another nation decides to run against a single candidate during the voting session.
3. Voting will be always remain voluntary and encouraged.
4. All nations who meet all of the requirements specified have the right to run for a political position.
5. All nations who run for a position must be a member of a political party. This must be announced before the commencing of the vote.
6. All nations in the region CAN vote, although, stated in Article V, Section 2, it is still voluntary.
7. A “Vote Update" must be posted on the status of the voting session at least once every twenty-four hours.
8. If a nation runs for an open position and no other nations run against them, there still must be a voting session.
9. All voting sessions will be run on the forums or as a regional poll, and only registered members may vote.
10. In case of a tie, a re-vote will be held. This must be held in the form of a regional poll.
11. Election Week, in which all the political positions are evaluated by the people, will be held on the first seven days of every other month.
12. In Election Week, all nations can (although it is not mandatory) fill out a ballot on the forums.
13. On the ballot for Election Week, all nations not against a candidate will have a "yay" or "nay" space on the ballot, and henceforth they will be thrown out of the position in case of more "nay"s than "yay"s.
14. On the ballot for Election Week, all nations not against a candidate will go through a regular voting process, as described in all previous Sections of Article V.
Article VI
Embassies
1. Apple Island WILL NOT create an embassy with ANY invader region, any size.
2. Apple Island will not create an embassy with any region that has relations with any invader region, regardless of size.
3. Apple Island will withdraw embassies upon discovery of ties between the other region and a major invader region.
4. All citizens of Apple Island have the right to request an embassy with another region through the forums. The Executives have all authority over these requests.
5. Apple Island will withdraw an embassy that contains any nations that have committed mutiny/rebellion against Apple Island.
Article VII
Forums
1. Any misuse of the forum will not be tolerated. This includes posting profanity and/or violent/threatening messages.
2. Any profanity or violent/threatining messages will be deleted immediately.
3. Any nation not residing in Apple Island may not post on the forums, even as a guest.
Article VIII
Regional Assembly
1. Within the Regional Assembly, proposals shall be approved by the Judge and Congress Members and subsequently voted on by Regional Assembly members.
2. The Judge and the two Congress Members will approve (or decline to approve) proposals.
1. If the Judge and both Congress Members say Yes, then it is sent on to the vote.
2. If the Judge and one Congress Member say Yes, then it is sent on to the vote.
3. If the Judge and zero Congress Members say Yes, then it will not be sent to vote.
4. If the Judge does not say yes, but both Congress members do, then it will be left up to the World Assembly Delegate to decide whether or not the proposal is to be voted on.
5. If the Judge does not say Yes, and less than two Congress members do, then it will not be sent on to vote.
3. The Founder, Delegate, Judge, and Congress may still vote on proposals after they are passed. In order for this to happen, at least three nations that fall under this classification must call for a revote.
4. Only registered members of both the forums and the Regional Assembly can vote on Regional Assembly issues.
5. Voting periods for new congress members will be held every other month.
6. All Regional Assembly voting sessions will be held for 4 days.
7. All Regional Assembly members, and only Regional Assembly members, are certified to create a proposal. This includes the executives, the Judge, and the Congressmen.
Article IX
In Case of a Founder Absence
A 'founder absence' is defined as:
When the Founder has no national activity for seven days or more.
A 'security threat' is defined as:
When one or more nation(s) moves to Apple Island during a period of founder absence from an invader region.
1. In order to alert nations of security threats and to temporarily stop all anti-raids, a Code System must be applied.
1. In case of no founder absence, Code Green will be posted in the World Factbook Entry for the region. During this time, all regional activities are normal.
2. In case of a founder absence without any invader threats, Code Yellow will be posted in the World Factbook Entry. During this time, all World Assembly nations must stop all anti-raid activities and endorse the World Assembly Delegate.
3. In case of a founder absence with one or more invader threat, Code Orange will be posted in the World Factbook Entry. During this time, all Voting sessions are postponed until Code Orange is no longer necessary, and all World Assembly nations must stop all anti-raid activities to endorse the Delegate.
4. In case of Apple Island being raided during a founder absence, Code Red will be posted in the forums. During this time, all government activity takes place on the forums before enough endorsements are gathered to retake Apple Island.
2. In the case of the Founder ceasing to exist, the region MUST be re-founded right away by the Vice Delegate.
Article X
In Case of Mutiny
1. In case of peaceful mutiny against our region, any nations who have taken part in this will be considered enemies, but not attacked.
2. If an outpost of Apple Island is taken by force due to rebellion, the Delegate/Founder have the right to choose to take it back by force.
3. In case of an attempted government takeover committed by nations within Apple Island, the founder has all the right to ban/eject all those nations.
4. To avoid a possible government takeover, the Founder and Delegate MUST announce whenever they will be away for a period longer than two days.
5. To avoid a possible government takeover, there will be an endorsement limit which will be changed depending on the number of delegate endorsements. All nations who do not abide by the endorsement limit will be banned/ejected.
Article XI
Additions/Changes to Constitution
1. Any additions/changes to the constitution must be recommended by a Regional Assembly member.
2. Any additions/changes to the constitution must be approved by both the Founder and Delegate before voting.
3. Any additions/changes to the constitution will go through the regular Regional Assembly voting procedure, ALTHOUGH only the Congress/Judge are certified to vote on this.
IN CONCLUSION,
The Constitution of Apple Island, written by the citizens of Apple Island, is the legit document all members of Apple Island must abide to, and therefore is the basic foundations of our laws.
